Legal Framework

Built on Solid Legal Ground

Every aspect of BorrowDrugs is designed to comply with federal and state regulations governing drug transfers between healthcare entities.

DEA Compliance

All controlled substance transfers comply with DEA Schedule II–V requirements, including Form 222 or CSOS electronic equivalents. Both parties must hold valid DEA registrations.

State Board of Pharmacy

Transfers are subject to the laws of both the lending and borrowing states. BorrowDrugs verifies active pharmacy licenses and state-specific borrowing regulations before facilitating any transfer.

FDA Regulations

Drug transfers must comply with FDA regulations on drug distribution, including proper labeling, storage, and chain-of-custody documentation. Expired or recalled drugs cannot be listed.

HIPAA & Privacy

Patient information is never shared on the platform. All user data is encrypted at rest and in transit. NPI numbers are verified through the CMS NPI Registry.

BorrowDrugs is a platform that facilitates connections between licensed healthcare entities. We do not dispense, distribute, or take title to any drugs. All transfers are between licensed parties and must comply with applicable federal and state law. Users are responsible for ensuring their transfers comply with all applicable regulations in their jurisdiction.

Process

How a Transfer Works

From registration to return, every step is documented and compliant.

NPI Verification

Register with your NPI number. We verify your credentials against the CMS NPI Registry and confirm your active pharmacy or prescriber license.

List or Search

Lenders post available inventory with full drug details, NDC codes, expiration dates, and storage requirements. Borrowers search by drug name, state, or schedule class.

Submit a Request

Borrowers submit a compliant request with clinical justification and a proposed return date. Lenders review and approve or reject within 24–48 hours.

Transfer & Receipt

Upon approval, a prescription-style receipt is generated for both parties. The receipt serves as the official compliance document for the transfer.

Return & Close

Borrowers return the equivalent drug within the agreed timeframe. If not returned, a 2.5% fee of the total drug value is automatically assessed.
